RESEARCH NOTES

01 Scope and evidence status

One formal administrative restriction is retained. This is not a finding of particular arrests, imposed penalties or measured cultural loss. Five other directions remain unestablished.

RESEARCH NOTES

02 Independent actor and practice context

The constitution reproduction explicitly labels its text as amended through March 2004. Articles 6 and 7 establish public/collective productive ownership and state-sector leadership as formal commitments; Articles 11 and 15 also recognize private sectors and a socialist market economy. These provisions supply institutional economic context beyond a label, not proof of actual ownership shares or every official’s beliefs. Article 85 identifies the State Council as central government. [4]

The Dalai Lama’s September 2011 statement affirms inherited Tibetan reincarnation-recognition procedures and institutional continuity while acknowledging the end of his political role and allowing public choice on continuation. It establishes the named institution’s stated adherence retrospectively; it is not a 2007 statement or independent authentication of all history or rebirth claims. [3]

The economic classification does not show that socialist economics caused the religious restriction. This case is not a claim about all socialist movements, all Tibetan Buddhists or every inherited custom.

REAL-WORLD · EVIDENCE

03 1. Socialist → Traditional Values — Formal administrative restriction

On July 18, 2007, China’s State Administration for Religious Affairs issued Order No.5 governing Tibetan Buddhist reincarnation recognition, effective September 1. Articles 5 and 9 require government approval; Article 7 prohibits unauthorized searches and recognitions. Article 11 provides administrative penalties and criminal responsibility where an offence is constituted. [1] [2]

Retained under harmful interactions as a formal restriction on customary institutional autonomy, this finding concerns promulgation of an authorization framework. It does not establish a particular enforcement incident, arrest, penalty, measured cultural loss or a judicial finding about the order. The Dalai Lama’s 2011 objection is separately attributed; criticism alone does not populate the reverse harmful category. [1] [3]

RESEARCH NOTES

09 Qualifications and remaining work

The order states a religious-protection rationale and respect for ritual and history, while excluding abolished feudal privileges and foreign direction. These stated aims are not demonstrated successful protection. The Chinese reproduction and ICT translation support the formal requirements; neither establishes every practical effect. [1] [2]

The official Chinese page reproduces the 2007 order under a later URL. The constitutional page was posted in 2014 but explicitly identifies the 2004 text. Neither is claimed as an authenticated 2007 archived capture. No current-law guidance or later amendment audit is offered. [1] [4]

The Dalai Lama’s statement is an interested institutional account. Its allegations of damage and political intent are not adopted as independently verified outcomes. Later trust arrangements or 2025 decisions must not be backdated. [3]

The earlier 2008 white paper’s general protection claims remain contextual leads. They do not establish successful preservation or a supportive direction. Independent implementation evidence is required before adding enforcement incidents or measured outcomes.

A rule issued by a particular state organ does not create collective guilt, universal hostility, an automatic moral score or a new gameplay mechanic.
